General terms and conditions of sale

1 Purpose of the Service

Motocab offers to the Client and/or to any passenger designated by him, its services of renting a motorized two-wheeled vehicle with driver in order to take them to the destination communicated (hereinafter the "Service").

2 Access to the service

If the Customer wishes to use the Service, he/she must order a vehicle by telephone on 0153901401 from Monday to Friday from 7:00 a.m. to 9:30 p.m., from 2:00 p.m. to 7:00 p.m. on Saturdays and from 4:00 p.m. to 9:30 p.m. on Sundays and holidays, leaving his/her name, address, telephone number, the route to be taken as well as a credit card number as a guarantee. In case of cancellation less than one hour before the scheduled appointment, the trip will be charged in its entirety. In particular cases of strikes or events causing particular traffic difficulties in the Paris region, the cancellation conditions may be modified. In this case, all customers will be informed at least 48 hours in advance by email and/or phone call.

3 Rates and payment terms

For occasional customers, payment is to be made by credit card over the phone or by check/cash at the pilot. For subscribers, invoices are payable upon receipt by check, bank transfer or credit card. Any invoice not paid within 30 days of its receipt, automatically entails the application of penalties of an amount equal to one and a half times the legal interest rate.

Motocab reserves the right to change its prices at its own discretion. In this case, the Client will be informed at least seven days in advance in writing.

4 Waiting

Motocab ne peut s’engager à plus de dix minutes d’attente sans appel de notification préalable au standard. En fonction des disponibilités des pilotes, une attente est possible avec une facturation de 1€/minute après 5 minutes offertes par rapport à l'horaire intial de réservation.
Aux aéroports un suivi de vol est effectué et la facturation de retard est de 1€/minutes 20 minutes après l'aterrissage du vol (les informations de vol fournies au moment de la réservation devant être reconnues par Paris Aéroport).
En cas de retard du chauffeur de Motocab par rapport à l’heure de réservation et sauf accord de décalage entre la Client et Motocab, il sera déduit 10% du montant de la course par tranche de dix minutes au-delà des 20 premières minutes dans la limite du montant du trajet, et sauf en cas de force majeure.

The evening (after 8pm) or night surcharges will be charged according to the actual departure time of the vehicle and not the reservation. (e.g. A reservation made for 7:50 pm with an actual departure at 8:10 pm will be charged the night surcharge plus the eventual delay).

5 Cancellation and changes

Any changes or cancellations made more than one hour before the trip are free of charge. If you cancel less than one hour before the pick-up time, the entire trip is due.

6 Motocab's services and responsibility

Motocab commits itself to do whatever is necessary to bring the passenger to his destination as soon as possible and in optimal safety conditions. In this respect, Motocab is responsible for the driving and custody of the vehicle and complies with the regulations of the Highway Code. Motocab is guaranteed by a solvent insurance company that covers the risks related to its activity in accordance with the legislation in force. Passengers, third parties with respect to the driver, are covered for all bodily, material and immaterial damages that they may suffer as a result of a traffic accident and this in an unlimited way, from the moment they get on the vehicle until they get off, except for damages caused by their fault. For safety reasons, it is forbidden to smoke, to carry flammable, explosive, corrosive or toxic substances. The non-respect of this stipulation engages the responsibility of the Client and the passenger. Motocab reserves the right to take any action. Animals are not admitted to the transport unless a specific arrangement has been made. In any case, Motocab will not be held responsible for this. It is expressly agreed that delays in the transport due to unforeseen traffic difficulties (traffic jams, accidents, detour, weather conditions, various events, etc.) do not give right to any kind of compensation. In case of damage to the equipment or vehicle caused by the passenger, any repair or change of the equipment, whatever the cause, will be charged to the Customer. Any damage caused to a third party as a result of the passenger's behaviour not complying with elementary safety rules will be the responsibility of the Client. Motocab reserves the right to remove the passenger from the vehicle if he/she does not comply with the safety instructions given by Motocab and this without the possibility of demanding reimbursement of the fare. In case of subcontracting a ride to an independent rider, the latter assumes full responsibility for the transfer and its consequences. A breakdown of the motorcycle that is not due to poor maintenance and that occurs on the way to pick up the Customer or during the trip with the Customer, can in no case give right to compensation. Any complaint is possible within 48 hours after the trip, by registered letter with acknowledgement of receipt. Any suitcase of 15 Kg can be refused by the driver and the trip will then be charged in its entirety.

7 Communication and data

By accepting the general conditions of sale, you authorize Motocab to communicate with you by email or telephone for any information that may seem necessary. You can at any time request that your personal information be deleted from our database.

8 Assignment of powers

The present general conditions of sale are subject to French law. In the event of disputes relating to the execution or interpretation of these terms and conditions, and if the Customer is a merchant, the Commercial Court of Paris is competent.
